The H-2A is a non-immigrant work visa that enables U.S. agricultural employers to bring foreign workers for temporary or seasonal jobs such as planting, cultivating, harvesting, or other agricultural duties.
For the Employer (Sponsor):
Must prove that there are not enough U.S. workers available
Must demonstrate that employing H-2A workers will not adversely affect the wages or conditions of U.S. workers
Must provide housing, transportation, and other required benefits
Must file an approved temporary labor certification with the Department of Labor (DOL)
For the Employee (Beneficiary):
Must have a valid job offer from a U.S. agricultural employer
Must meet the requirements of the job (experience, physical ability, etc.)
Must return to their home country after the visa period ends
Initial Period: Generally based on the job and certification — usually up to 10 months
Extensions: Possible in increments of 1 year, up to a total of 3 years
After 3 years, the worker must leave the U.S. for at least 3 months before seeking re-entry on another H-2A visa.
Spouses and unmarried children under 21 may apply for H-4 dependent visas.
However, dependents are not permitted to work under H-4 status.
