  • Must prove that there are not enough U.S. workers available

  • Must file an approved temporary labor certification with the Department of Labor (DOL)

For the Employee (Beneficiary):

  • Must have a valid job offer from a U.S. agricultural employer

  • Must meet the requirements of the job (experience, physical ability, etc.)

  • Must return to their home country after the visa period ends

H-2A Visa Duration and Extensions

  • Initial Period: Generally based on the job and certification — usually up to 10 months

  • Extensions: Possible in increments of 1 year, up to a total of 3 years

After 3 years, the worker must leave the U.S. for at least 3 months before seeking re-entry on another H-2A visa.

Dependents: H-4 Visa

Spouses and unmarried children under 21 may apply for H-4 dependent visas.
However, dependents are not permitted to work under H-4 status.
