The H-2B is a non-immigrant work visa designed to help U.S. employers bring foreign workers to the U.S. for temporary or seasonal non-agricultural work when qualified U.S. workers are not available.
For the Employer (Sponsor):
Must prove a temporary or seasonal need for workers
Must show there are not enough U.S. workers available
Must demonstrate that hiring foreign workers will not negatively impact U.S. workers’ wages or conditions
Must obtain a temporary labor certification from the U.S. Department of Labor (DOL)
Must pay the prevailing wage for the job
For the Employee (Beneficiary):
Must have a valid job offer from a U.S. employer
Must meet job-specific requirements (skills, experience, physical ability, etc.)
Must be willing to return home after visa expiration
Cap: 66,000 H-2B visas issued each year
33,000 for the first half of the fiscal year (October–March)
33,000 for the second half (April–September)
Some additional visas may be made available under a supplemental cap, depending on U.S. government policy.
Initial Period: Up to 1 year
Extensions: Possible in increments of up to 1 year, for a maximum of 3 years total
After 3 years, the worker must leave the U.S. for at least 3 months before reapplying.
