H-2B Visa Eligibility

For the Employer (Sponsor):

  • Must prove a temporary or seasonal need for workers

  • Must show there are not enough U.S. workers available

  • Must demonstrate that hiring foreign workers will not negatively impact U.S. workers’ wages or conditions

  • Must obtain a temporary labor certification from the U.S. Department of Labor (DOL)

  • Must pay the prevailing wage for the job

For the Employee (Beneficiary):

  • Must have a valid job offer from a U.S. employer

  • Must meet job-specific requirements (skills, experience, physical ability, etc.)

  • Must be willing to return home after visa expiration

H-2B Visa Cap (Annual Quota)

  • Cap: 66,000 H-2B visas issued each year

    • 33,000 for the first half of the fiscal year (October–March)

    • 33,000 for the second half (April–September)

Some additional visas may be made available under a supplemental cap, depending on U.S. government policy.

  • Initial Period: Up to 1 year

  • Extensions: Possible in increments of up to 1 year, for a maximum of 3 years total
