Who Needs a PERM Certification?
PERM is generally required for the following employment-based immigrant visa categories:
EB-2: Required for professionals holding advanced degrees (Master’s or higher) or those with exceptional ability, unless the application is filed under a National Interest Waiver (NIW).
EB-3: Required for Skilled Workers (requiring two or more years of experience), Professionals (requiring a Bachelor’s degree), and Unskilled Workers (other workers).
Important Note: The EB-1 category (Extraordinary Ability, Outstanding Researchers/Professors, and Multinational Managers/Executives) and the EB-2 National Interest Waiver (NIW) do not require the PERM labor certification process.
