CR-1 Visa

CR-1 Visa (Conditional Resident Visa)

The CR-1 Visa allows the foreign spouse of a U.S. citizen to immigrate to the United States as a lawful permanent resident. This visa provides a direct path to a Green Card and the right to live, work, and travel freely in the U.S.

What is a CR-1 Visa?

The CR-1, also called the Conditional Resident Visa, is issued when a couple has been married for less than two years at the time of approval. The “conditional” status ensures the marriage is genuine and not solely for immigration benefits.

After two years, the couple must apply to remove conditions and obtain a 10-year Green Card.

Why Choose a CR-1 Visa?

  • Enter the U.S. as a permanent resident (not on a temporary visa).

  • Work authorization is automatic upon arrival.

  • Access to U.S. benefits including healthcare and education.

  • Clear pathway to U.S. citizenship after fulfilling eligibility.

Eligibility Requirements

To qualify for a CR-1 Visa, you must:

  • Be legally married to a U.S. citizen.

  • Have a marriage less than two years old at the time of visa issuance.

  • Prove your marriage is genuine and bona fide (evidence required).

  • Ensure the U.S. spouse meets minimum income/sponsorship requirements.

CR-1 Visa Process

  1. Petition Filing (Form I-130): The U.S. citizen files the petition with USCIS.

  2. Approval & NVC Processing: Case is forwarded to the National Visa Center for further review.

  3. Consular Processing: Documents, fees, and supporting evidence are submitted.

  4. Visa Interview: Conducted at the U.S. embassy or consulate in the spouse’s country.

  5. Entry to the U.S.: Spouse enters as a conditional permanent resident.

  6. Removal of Conditions: After 2 years, file Form I-751 jointly to obtain a 10-year Green Card.

Documents Required

  • Valid marriage certificate.

  • Proof of relationship (photos, chats, joint accounts, etc.).

  • Passport and identity documents.

  • Affidavit of support (Form I-864).

  • Medical examination results.

  • Other supporting documents requested by USCIS/NVC.
