EB-3 Visa (Employment-Based Third Preference)

The EB-3 Visa is an employment-based immigrant visa designed for skilled workers, professionals, and other workers seeking permanent residency in the United States. It is a reliable pathway for individuals with the appropriate education, work experience, and job offers from U.S. employers.

What is an EB-3 Visa?

The EB-3 Visa falls under the Employment-Based Third Preference (EB-3) category. It allows foreign nationals to live and work permanently in the United States with the support of a sponsoring U.S. employer.

The EB-3 Visa is divided into three subcategories:

  • Skilled Workers: Individuals with at least 2 years of job experience or training.

  • Professionals: Individuals holding a U.S. bachelor’s degree or foreign equivalent.

  • Other Workers: Individuals performing unskilled labor requiring less than 2 years of experience.

Unlike EB-1 or EB-2, EB-3 typically requires labor certification (PERM) from the Department of Labor to ensure that no qualified U.S. worker is available for the job.

Why Choose an EB-3 Visa?

  • Grants permanent residency (Green Card) in the U.S.

  • Eligible to include spouse and unmarried children under 21 as derivative beneficiaries.

  • Access to stable employment and career growth opportunities in the U.S.

  • Enables living, studying, and working anywhere in the United States.

  • Ideal for a wide range of professionals, skilled workers, and other labor categories.

Eligibility Requirements

Skilled Workers

  • Minimum of 2 years of training or work experience in the occupation.

  • Must have a permanent full-time job offer from a U.S. employer.

Professionals

  • Must hold a U.S. bachelor’s degree or foreign equivalent.

  • Job offer must require a bachelor’s degree.

Other Workers

  • Performs unskilled labor that requires less than 2 years of training or experience.

  • Must have a permanent job offer from a U.S. employer.

Additional Requirements:

  • Employer must obtain PERM labor certification from the Department of Labor.

  • Applicant must meet health, security, and admissibility standards.

EB-3 Visa Process

  1. Labor Certification (PERM): Employer files PERM with the U.S. Department of Labor to demonstrate no qualified U.S. worker is available.

  2. Petition Filing (Form I-140): Employer submits Form I-140 to USCIS after PERM approval.

  3. Priority Date & Visa Bulletin: Check visa availability, as EB-3 is subject to annual numerical limits and country-specific backlogs.

  4. Adjustment of Status (I-485) or Consular Processing: Apply for Green Card if the priority date is current.

  5. Biometrics & Interview: Attend USCIS biometrics and possible interview.

  6. Green Card Issuance: Receive permanent residency in the U.S.

Documents Required

  • Valid passport.

  • Job offer letter from a U.S. employer.

  • PERM labor certification approval.

  • Educational credentials (degrees, transcripts, or training certificates).

  • Work experience letters (for skilled workers).

  • USCIS forms (I-140, I-485 if adjusting status).

  • Birth and marriage certificates (for derivative beneficiaries).

  • Medical examination report.

Timeline & Processing Time

  • PERM Labor Certification: 6–12 months

  • I-140 Petition Processing: 6–12 months

  • Adjustment of Status or Consular Processing: 6–12 months

  • Overall Processing: Typically 12–36 months, longer for applicants from countries with visa backlogs (e.g., India, China).

EB-3 vs. Other Employment-Based Visas

  • EB-1: Extraordinary ability, outstanding researchers, multinational executives (fastest processing).

  • EB-2: Advanced degree or exceptional ability (labor certification required unless NIW).

  • EB-3: Skilled workers, professionals, and other workers (longer wait times due to backlogs).

  • EB-4: Special immigrants (religious workers, translators, etc.).

  • EB-5: Investor visa for significant U.S. investment creating jobs.
