EB-5 Visa (Employment-Based Fifth Preference – Investor Visa)

The EB-5 Visa is an employment-based immigrant visa that allows foreign investors and their immediate family to obtain permanent residency (Green Card) in the United States by making a qualifying investment that creates jobs for U.S. workers. It is one of the fastest pathways for investors and their families to live, work, and study in the U.S. permanently.


What is an EB-5 Visa?

The EB-5 Visa falls under the Employment-Based Fifth Preference (EB-5) category and is designed for individuals willing to invest a significant amount of capital in a U.S. business that generates employment.

Key features of the EB-5 Visa:

  • Investor and eligible family members (spouse and unmarried children under 21) gain Green Cards.

  • Investment is required in a new commercial enterprise.

  • The investment must create or preserve at least 10 full-time jobs for U.S. workers.

Eligibility Requirements

To qualify for an EB-5 Visa:

  • Make a minimum qualifying investment:

    • $1.05 million in a standard commercial enterprise.

    • $800,000 if investing in a Targeted Employment Area (TEA) (high unemployment or rural area).

  • Invest in a new commercial enterprise (started after November 29, 1990) or a troubled business.

  • Investment must create at least 10 full-time jobs for U.S. workers within 2 years.

  • Investor must actively participate in the business.

  • Must demonstrate the lawful source of investment funds.


EB-5 Visa Process

  1. Select Investment Project: Choose a qualified commercial enterprise or Regional Center project.

  2. Form I-526 Petition: Submit I-526 immigrant petition to USCIS with evidence of investment and job creation.

  3. USCIS Approval: Petition approval confirms eligibility for a conditional Green Card.

  4. Visa Application / Adjustment of Status: Apply for conditional permanent residency via U.S. consulate or Form I-485 in the U.S.

  5. Conditional Green Card Issuance: Granted for 2 years initially.

  6. Remove Conditions (Form I-829): Within 90 days before the 2-year mark, submit Form I-829 to remove conditions and obtain a permanent Green Card.


Documents Required

  • Proof of investment (bank statements, wire transfers, business agreements).

  • Business plan demonstrating creation of at least 10 jobs.

  • Source of funds documentation (tax returns, sale of assets, inheritance, etc.).

  • USCIS forms (I-526, I-485 if in U.S., I-829 for removing conditions).

  • Valid passport.

  • Birth and marriage certificates for dependents.

  • Medical examination results.

  • Other supporting documentation as requested by USCIS.

  • I-526 Petition Processing: 12–24 months (may vary depending on backlog).

  • Consular Processing / Adjustment of Status: 6–12 months.

  • Conditional Green Card: 2 years.

  • Form I-829 (remove conditions): 12–18 months after submission.

  • Overall Timeline: Typically 3–5 years, depending on processing times and investment verification.
