H-2A Visa (Temporary Agricultural Work Visa)

The H-2A Visa is a non-immigrant visa that allows U.S. employers to hire foreign nationals for temporary or seasonal agricultural work. It provides a legal pathway for workers to contribute to the U.S. agricultural industry while living and working in the United States temporarily.

What is an H-2A Visa?

The H-2A Visa is specifically designed for temporary or seasonal agricultural employment in the United States. It allows U.S. employers to hire foreign workers when there are not enough domestic workers available to fill these positions.

Key features of the H-2A Visa:

  • Allows temporary employment in agriculture for the duration of the work contract.

  • Visa validity can range from 1 month up to 1 year, with extensions available in some cases.

  • Eligible to include spouse and children under 21 in limited circumstances (through H-4 or dependent visa options).

  • Requires employer sponsorship and a valid job offer in agriculture.

Why Choose an H-2A Visa?

  • Provides legal employment authorization for agricultural work in the U.S.

  • Opportunity to gain international work experience.

  • Employer-provided housing, transportation, and insurance (mandatory in most cases).

  • Short-term, structured employment with the ability to return home or extend under certain conditions.

  • Supports the U.S. agricultural industry and seasonal workforce needs.

Eligibility Requirements

To qualify for an H-2A Visa:

  • Must have a job offer from a U.S. agricultural employer for temporary or seasonal work.

  • Employer must demonstrate insufficient U.S. workers available for the job.

  • Must meet health, security, and admissibility standards.

  • Must demonstrate the ability to perform agricultural work.

  • Must maintain temporary intent (return home after employment ends).

  2. Department of Labor Certification: Employer obtains temporary labor certification from the U.S. Department of Labor.

  3. USCIS Petition Approval: Petition is reviewed and approved by USCIS.

  4. Visa Application & Interview: Worker applies for H-2A visa at the U.S. consulate and attends an interview.

  5. Entry to the U.S.: Upon approval, the worker enters the U.S. to begin employment.

  6. Employment Completion: Work is limited to the contract duration; extensions may be possible.
